Terms & Conditions

The following Terms and Conditions (the "Agreement") constitute a legally binding contract between Premium Gold Buyer (including its staff, representatives, affiliates, directors, and contractors, collectively referred to as "We," "Us," or "Our") and any individual or business entity (referred to as the "Customer," "Seller," "You," or "Your") who sells items to Us.

Any property presented to Us for evaluation or sale—including, but not limited to, jewelry, gold, silver, platinum, palladium, diamonds, coins, watches, or other precious materials—will be referred to as "Goods" or "Items."

1. Compliance with Federal and Provincial Laws

Premium Gold Buyer operates in strict compliance with the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and Alberta provincial regulations. We are legally mandated to verify identity, maintain precise transactional records, and report designated transactions to relevant government authorities (including FINTRAC).

2. Legal Requirements for Sellers

By presenting Goods to Us, You warrant and declare that:

  1. You are at least 18 years of age.

  2. You have provided Your authentic full legal name, current address, telephone number, and two (2) pieces of valid government-issued photo identification, as strictly required under Alberta law.

  3. You are the sole, lawful, absolute owner of the Goods being sold, and have full legal authority to transfer unencumbered title to Us. You act exclusively on Your own behalf and not as an agent, representative, or nominee for any third party.

  4. We reserve the absolute right to request verifiable proof of ownership and to decline any purchase at Our sole discretion without disclosing a reason.

3. Finality of Transaction and Payment

  1. Binding Agreement: By accepting payment from Us via Cash, Electronic Funds Transfer (e-Transfer), Direct Deposit, Corporate Cheque, or e-Check, You explicitly agree to all terms stated herein.

  2. Irrevocability: Once payment has been issued, the transaction is final and legally irrevocable. Title to the Goods transfers immediately to Us, and the Goods will be queued for immediate processing, melting, or refining. Under no circumstances can Items be returned to You after payment issuance.

  3. Cheque/Payment Policy: Payments are made in good faith and are non-refundable. Any corporate cheque issued by Us must be treated with the security of cash. We will not issue duplicate or replacement cheques under any circumstances, including loss, theft, or destruction after handoff or mailing.

4. Mail-In and Remote Services

For Goods sent to Us via mail, courier, or freight services from anywhere within Canada:

  1. Shipping Risks: We provide fully insured shipping labels for Your convenience. However, You are solely responsible for ensuring the Items are packaged securely following Our safe-shipping guidelines (e.g., omitting words like "gold", "jewelry", or "cash" from the exterior packaging).

  2. Inspection and Surveillance: Upon arrival at our facility, all packages are opened, logged, and evaluated under high-definition video surveillance. The weight and purity determined by our calibrated, certified testing equipment (including XRF technology) shall serve as the official baseline for our offer.

  3. Rejection of Offer: If You decline our purchase offer, the Items will be securely repackaged and shipped back to Your registered address fully insured, at no cost to You.

5. Counterfeit, Restricted, and Misrepresented Items

It is unlawful to traffic in counterfeit, stolen, or fraudulently misrepresented property.

  1. If any Goods sold to Us are later determined by internal testing or third-party refinery audits to be counterfeit, gold-plated rather than solid, or of a lower purity than stated in the Calculation Summary, You agree to fully refund the purchase price to Us immediately upon demand ("Refund and Return").

  2. We reserve the right to cancel or place a stop-payment on any outstanding cheques, reverse electronic transfers, and pursue full legal and financial recovery for damages.

  3. Any suspected criminal activity, fraudulent representations, or stolen property will be reported immediately to law enforcement authorities alongside Your submitted identification records.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Premium Gold Buyer shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or property value. We are not responsible for the loss, damage, or destruction of property while in transit or in Our possession, regardless of cause, including negligence, except as explicitly mandated by provincial consumer protection laws. By finalizing a transaction, You waive any right of subrogation for Yourself and on behalf of Your insurance providers.

7. Indemnification

You agree to defend, indemnify, and hold completely harmless Premium Gold Buyer, its parent entities, affiliates, directors, and employees against any and all claims, financial losses, costs, legal fees, damages, or liabilities arising directly or indirectly from a breach of this Agreement, an invalid transfer of title, or any misrepresentation made by You regarding the ownership, identity, or purity of the Goods.

8. General Provisions

  1. Independent Relationship: This Agreement does not create an agency, partnership, joint venture, employment, or franchise relationship between You and Us.

  2. Assignment: You may not transfer or assign Your rights or obligations under this Agreement. We may assign Our rights without restriction.

  3. Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

  4. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein.
